Coco Lee, its representatives and associated agents are not liable to you or any other for any loss in connection with the use of this Site or a Linked Web Site. This general disclaimer is not restricted or modified by any of the following specific warnings and disclaimers.

Privacy Policy

Cocolee undertakes not to disclose any information provided by Members on the Website to third parties. Any such information will be treated as confidential. It will only be used internally for the purposes of processing the Member's order and to strengthen and personalise the communication including by means of letters / e-mails providing information and for the purposes of the personalisation of the Website according to Members' recorded preferences.

This means that Cocolee will not sell, market or lease any personal data about its Members to third parties.

Where Members have given consent, either at the point at which they register onto the site, or later on consultation of its account page once registered, to the receipt of emails from Cocolee, Cocolee may send information or promotional emails to the Member.

Authenticity of Products

Cocolee guarantees product have all been sourced directly from the designer, all are real and true to the designer brand. Cocolee guarantees no copies or 'fakes' wil be sold in any of Cocolee sale departmnts.

Cocolee cannot guarantee the authenticity of any of the products posted on fashion marketplace. Cocolee does not hold, or deliver any of the fashion marketplace items from it's office. Judgement of these products is left to the the discretion buyer and seller.

Availability of Products

If a product or service is totally or partially unavailable after the order is made, the Member shall be informed via email within 7-14 business days of the ordering having been processed of the delivery of a partial order or the cancellation of his or her order. If this is the case, a Member has the right to ask Cocolee to:

Deliver a product or service of equivalent quality and at an equivalent price, subject to stock and availability;
To refund the price of the product or service ordered within 30 days from his or her request.

The Cocolee website has one of the most efficient and current e-commerce security systems. Not only does it use SSL (Secure Socket Layer) encryption, it has also reinforced all of the various encryption processes in order to provide the most effective protection possible for all sensitive payment information.

Cocolee holds no responsibility for the transaction of information that takes place at third party sites where personal information and payment details are transacted.

Credit Card Fraud

Cocolee will not be responsible for any damages, consequential losses (whether direct or indirect) suffered by a customer whose credit card is fraudulently used or is used in an unauthorised manner.

Australian Orders are usually received within 7-14 working days unless otherwise noted

International orders can take up to 14-21 days to be received

All orders are sent by Australia Post Express.

Returns

All products purchased are subject to a strict 7 Day return Policy. Customers are expected to return products within 7 Days of receipt.

Cocolee happily offers exchanges or credit notes in the case of returns. Credit notes are valid for 3 months from date of issue. Refunds are only offered if goods are received in a damaged or faulty condition

In order to be fully eligible for an exchange or return as per the conditions set out above, the Member must return the product or service to Cocolee:

Subject to having contacted Cocolee (via the contact section) with the request and reason for the return. Please contact via email to customercare@cocolee.com.au
Properly protected, with its original packaging, in the condition delivered (no additional damage) together with any accessories, instructions and documentation;
Together with original invoice received identifying the order placed inside the return parcel;

(Damaged Goods & Services )

In the event of damaged products delivered to Members they may return them to Cocolee. The member may be eligible for

Exchange for a product or service of equivalent quality and at an equivalent price, subject to availability; or
Refund the price of the product or service ordered

In order to be fully eligible for a refund as per the conditions set out above, the Member must return the product or service to Cocolee:

Fashion Marketplace Terms of Use.

These terms are effective January 1st, 2009.By accessing the Fashion Marketplace on COCOLEE.com.au you are agreeing to the following terms, which are designed to make sure that Coco Lee works for everyone.

violate any laws;
post any threatening, abusive, defamatory, obscene or indecent material;
be false or misleading;
infringe any third-party right;
distribute or contain spam, chain letters, or pyramid schemes;
distribute viruses or any other technologies that may harm Coco Lee or the interests or property of Coco Lee users;
mpose an unreasonable load on our infrastructure or interfere with the proper working of Coco Lee;
copy, modify, or distribute any other person's content without their consent;
use any robot spider, scraper or other automated means to access Coco Lee and collect content for any purpose without our express written permission;
harvest or otherwise collect information about others, including email addresses, without their consent;
bypass measures used to prevent or restrict access to Coco Lee.

Using Fashion Marketplace. As a condition of your use you agree that you will not:

Coco Lee and the Coco Lee community work together to keep the site working properly and the community safe. Please report problems, offensive content and policy breaches to us at customercare@cocolee.com.au

Without limiting other remedies, we may issue warnings, limit or terminate our service, remove hosted content and take technical and legal steps to keep users off Coco Lee if we think that they are creating problems or acting inconsistently with the letter or spirit of our policies. However, whether we decide to take any of these steps, remove hosted content or keep a user off Coco Lee or not, we do not accept any liability for monitoring Coco Lee or for unauthorized or unlawful content on Coco Lee or use of Coco Lee by users.

Infringement.

Do not post content that infringes the rights of third parties, This includes, but is not limited to, content that infringes on intellectual property rights such as copyright and trademark (e.g. offering counterfeit items for sale). A large number of very varied products are offered on Coco Lee by private individuals in Australia. Entitled parties, in particular the owners of copyright, trademark rights or other rights owned by third parties can report any offers which many infringe on their rights, and submit a request for this offer to be removed. If a legal representative of the entitled party reports this to us in the correct manner, products infringing on the intellectual property rights will be removed by Coco Lee.

Liability.

Nothing in these terms shall limit our liability for fraudulent misrepresentation, for death or personal injury resulting from our negligence or the negligence of our agents or employees. You agree not to hold us responsible for things other users post or do.

In no event do we accept liability of any description for the posting of any unlawful, threatening, abusive, defamatory, obscene or indecent information, or material of any kind which violates or infringes upon the rights of any other person, including without limitation any transmissions constituting or encouraging conduct that would constitute a criminal offence, give rise to civil liability or otherwise violate any applicable law.

We do not review user's postings and are not involved in the actual transactions between users. As most of the content on Fashion Marketplace comes from the other users, we do not guarantee the accuracy of postings or user communications or the quality, safety ,or legality of what's offered.

We cannot guarantee continuous, error-free or secure access to our services or that defects in the service will be corrected. While we will use reasonable efforts to maintain an uninterrupted service, we cannot guarantee this and we do not give any promises or warranties (whether express or implied) about the availability of our services.

Accordingly, to the extent legally permitted we expressly disclaim all warranties, representations and conditions, express or implied, including those of quality, merchantability, merchantable quality, durability, fitness for a particular purpose and those arising by statute. How to Enter
Entrants must sign up to join CocoLee.com.au by entering their email address, password and postcode in the competition being run by Commission Monster.
Once filling out this form and pressing the Join CocoLee button, the entrant is entered automatically into the competition

Conditions of Entry
1. Instructions on how to enter and prizes form part of these Conditions of Entry. If there is any conflict between these Conditions of Entry and any other material, then these Conditions of Entry will prevail.
2. Staff and the immediate families of CocoLee.com.au, Commission Monster, its agencies associated with any companies providing services or benefits to this promotion are ineligible.
3. There is no limit on the number of times an entrant can enter the competition but each entry will be recorded in accordance with the entry requirements.
4. The Promoter reserves the right to verify the validity of entries, at any time during or after the closing date, and to disqualify any entrant who tampers with the entry process or who submits an entry that is not in accordance with these Conditions of Entry.
5. Promotion commences Monday May 9, 2011 and closes Friday July 29, 2011 midnight AEST.
6. The draw will take place at CocoLee.com.au Head Offices at Suite 310, 50 Holt St, Surry Hills at 10am EST on Monday August 8, 2011. The winners will be notified by email and / or phoned - and will be announced on the website of CocoLee.com.au on Friday August 12, 2011.
7. The judge's decision is final and no correspondence will be entered into.
8. The winner will be randomly selected using a computer-based engine from a pool of people who joined CocoLee.com.au during the promotional period.
9. The total prize pool is $1000. Promotional offer of 1 (one) Apple Ipad, $600 and 1 (one) Marc Jacobs ipad cover, $400.
10. After the winner has been confirmed and a current delivery address is provided - the prize will be posted to the winner.
11. Prize is not refundable, non-endorsable or non-transferable.
12. The promoter may conduct further draws at the same time and place as the original draw as is necessary on 09/11/11 in order to distribute a prize if unclaimed by that date. All unclaimed prize draw winners will be notified by email and the unclaimed prize draw winner of prize will be announced on www.cocolee.com.au on 12/08/11.
13. All entries become the property of the promoter.
14. If the winner of a prize is under the age of 18 years the prize will be awarded to the winner's parent or guardian.
15. The Promoter shall not be liable for any loss or damage whatsoever which is suffered (including but not limited to indirect or consequential loss) or for personal injury which is suffered or sustained, as a result of taking the prize, except for any liability which cannot be excluded by law.
16. The Promoter is not responsible for any incorrect or inaccurate information, caused by the website user or for any of the equipment or programming associated with or utilised in this competition, or for any technical error, or any combination thereof that may occur in the course of the administration of this competition including any omission, interruption, deletion, defect, delay in operation or transmission, communications line or telephone, mobile or satellite network failure, technical problems or traffic congestion on the Internet or website, software failure, theft or destruction or unauthorised access to or alteration of entries and any injury or damage to participants or any other person's computer related to or resulting from participation in or down-loading any materials in this competition.

If for any reason this competition is not capable of running as planned (including but not limited to) technical failures, unauthorised intervention, fraud or any other causes beyond the control of the Promoter which corrupts or affect the administration, security, fairness, integrity or proper conduct of this competition, the Promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process, and, subject to any written directions given by the various Lottery Departments, to cancel, terminate, modify or suspend the competition.
18. Any costs associated with accessing the website is the entrant's responsibility and is dependent on the Internet service provider used. Any contact details entered incorrectly on the website shall be deemed invalid.
19. The Promoter collects entrants' personal information in order to conduct the promotion. If the information requested is not provided, the entrant may not participate in the promotion. By entering the promotion, unless otherwise advised, each entrant also agrees that the Promoter may use this information, or disclose it to other organisations that may use it, in any media for future promotional, marketing and publicity purposes without any further reference, payment or other compensation to the entrant, including sending the entrant electronic messages.
